Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Student," or "you") and Coursaily ("Company," "we," "us," or "our"), governing your access to and use of our WhatsApp-based educational services, courses, and related content.

By initiating a conversation with our WhatsApp number (+92 326 4586236), enrolling in a course, making a payment, or accessing any content provided by Coursaily, you confirm that you have read, understood, and agreed to be bound by these Terms.

We reserve the right to modify these Terms at any time. Continued use of our services after any such changes constitutes your acceptance of the new Terms. We will notify active students of material changes via WhatsApp message.

Description of Services

Coursaily is a WhatsApp-native educational platform that delivers structured micro-courses to learners in Pakistan and beyond. Our services include:

• AI-powered, interactive teaching delivered entirely through WhatsApp messaging
• Structured 10-day micro-courses covering practical skills including AI usage and English for freelancers
• Daily quizzes, exercises, and progress tracking
• Daily digital cheat sheets and completion badges upon finishing each day's lesson
• A final course completion certificate and badge upon completing all 10 days
• Automated nudges and reminders to support consistent daily learning

Our services are delivered through Meta's WhatsApp Business Cloud API and powered by artificial intelligence. The quality and availability of our services depend on your access to WhatsApp and a working internet connection.

Eligibility

To use Coursaily's services, you must:

• Be at least 13 years of age. If you are between 13 and 18 years of age, you must have consent from a parent or legal guardian
• Have a valid WhatsApp account and active Pakistani or international mobile number
• Have the legal capacity to enter into a binding agreement under Pakistani law
• Not be prohibited from receiving our services under any applicable law

By using our services, you represent and warrant that you meet all eligibility requirements listed above.

Account Registration & Student Profile

Your Coursaily account is created automatically when you first message our WhatsApp number. Your WhatsApp phone number serves as your unique identifier in our system. You are responsible for:

• Providing accurate information including your name and language preference
• Maintaining the security and confidentiality of your WhatsApp account
• All activities that occur through your WhatsApp number on our platform
• Notifying us immediately if you believe your account has been compromised

Each WhatsApp number is entitled to one student profile. Sharing your course access with others by allowing them to use your WhatsApp is not permitted and may result in account suspension.

Payment & Fees

Course fees are displayed clearly before enrollment. All prices are stated in Pakistani Rupees (PKR) and are subject to change. We currently accept payment through:

• JazzCash (mobile wallet and bank transfer)
• EasyPaisa (mobile wallet and bank transfer)
• Raast (instant bank transfer)
• Bank transfer to our registered business account
• Other payment methods as made available from time to time

Your enrollment is confirmed only upon receipt of full payment. Coursaily reserves the right to withhold course access until payment is verified. In the event of a payment dispute, you agree to provide supporting transaction evidence upon request.

Refund Policy

We want every student to succeed. Our refund policy is as follows:

• Full refund: Available within 24 hours of payment if you have not yet started Day 1 of your course
• Partial refund: If you have completed fewer than 3 days of your course, you may request a 50% refund within 48 hours of enrollment
• No refund: After completing 3 or more days, or after 48 hours from enrollment, whichever comes first, no refund will be issued
• Technical issues: If you are unable to access your course due to a technical error on our part, we will either resolve the issue or issue a full refund at our discretion

To request a refund, contact us at hello@coursaily.com or message us on WhatsApp. Refunds will be processed within 7–10 business days to the original payment method.

We reserve the right to refuse refunds where we have reasonable grounds to believe the refund policy is being abused.

Course Content & Access

Upon enrollment and payment confirmation, you are granted a limited, non-transferable, non-exclusive license to access and use the course content for personal, non-commercial educational purposes.

Course content is delivered over a 10-day period with one lesson per day. The following conditions apply:

• Each day's lesson becomes available after the previous day is completed and a minimum rest period has elapsed
• You must actively engage with the course through WhatsApp to progress — passive enrollment does not advance your progress
• Course content including cheat sheets, badges, and lesson materials are for your personal use only
• You may not reproduce, redistribute, sell, or share course content without prior written permission from Coursaily
• Digital badges and certificates are issued to the WhatsApp number used during enrollment only

Coursaily reserves the right to update, modify, or improve course content at any time to ensure quality and relevance. Such changes will not materially diminish the value of a course you have already enrolled in.

User Conduct

You agree to use Coursaily's services responsibly and in good faith. The following conduct is strictly prohibited:

• Using abusive, offensive, threatening, or harassing language in any communication with our AI system or support team
• Attempting to manipulate, deceive, or exploit our AI teaching system to obtain answers without genuine engagement
• Sharing your course access credentials or allowing others to use your enrollment
• Attempting to reverse engineer, copy, or replicate our course delivery system or AI methodology
• Using our platform for any commercial purpose including reselling course access
• Submitting false payment information or attempting to obtain course access through fraudulent means
• Any conduct that disrupts the experience of other students or the operation of our services

Violation of these conduct standards may result in immediate suspension of your account without refund and, where appropriate, reporting to relevant authorities.

WhatsApp Usage & Communications

Coursaily delivers its services exclusively through WhatsApp. By enrolling, you expressly consent to receiving WhatsApp messages from our business number (+92 326 4586236) including:

• Daily lesson content, exercises, and quiz questions
• Progress updates, scores, and feedback
• Reminder and nudge messages to encourage course completion
• Course completion badges and cheat sheets
• Payment confirmations and enrollment updates
• Occasional service announcements relevant to your enrollment

You may opt out of non-essential communications at any time by messaging "STOP" to our WhatsApp number. However, opting out of core lesson delivery messages will effectively pause your course progress.

Coursaily is not responsible for any delays, failures, or interruptions in WhatsApp delivery caused by Meta, your mobile network provider, or factors outside our control. We are also not responsible for any charges you incur from your mobile data provider for receiving WhatsApp messages.

Intellectual Property

All content, materials, methodology, branding, and technology associated with Coursaily — including but not limited to course content, the CARE teaching framework, AI prompts, cheat sheets, badges, logos, and the Coursaily name — are the exclusive intellectual property of Coursaily and are protected under applicable Pakistani and international intellectual property laws.

You are granted a limited license to use course materials for your personal learning only. This license does not include the right to:

• Copy, reproduce, or distribute any course content in any form
• Create derivative works based on Coursaily content
• Use the Coursaily name, logo, or branding without written permission
• Claim ownership of any content created by Coursaily

Any content you share with Coursaily — such as feedback, testimonials, or exercise responses — you grant us a non-exclusive, royalty-free license to use for improving our services and for marketing purposes, provided we anonymise personal details unless you have explicitly consented to being identified.

Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our services, you consent to the collection and processing of your personal data as described in our Privacy Policy. We encourage you to read the Privacy Policy carefully before using our services.

Disclaimers

Coursaily's services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

• The accuracy, completeness, or fitness for a particular purpose of any course content
• Guaranteed learning outcomes or career advancement as a result of completing any course
• Uninterrupted, error-free, or secure delivery of services via WhatsApp
• The accuracy or reliability of AI-generated teaching responses

Our courses are designed to provide foundational knowledge and practical skills. We do not guarantee that completing a Coursaily course will result in specific employment, income, or professional outcomes. Results vary based on individual effort, application, and external factors beyond our control.

Coursaily uses artificial intelligence to deliver teaching content. While we design our AI prompts carefully, AI responses may occasionally contain errors. We continuously monitor and improve our AI systems but cannot guarantee perfection.

Limitation of Liability

To the maximum extent permitted under applicable Pakistani law, Coursaily, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services.

In no event shall Coursaily's total liability to you for any claims arising from these Terms or your use of our services exceed the amount you paid to Coursaily in the three months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

Termination

Coursaily reserves the right to suspend or terminate your access to our services, with or without notice, if:

• You violate any provision of these Terms
• We suspect fraudulent or abusive behaviour
• We are required to do so by applicable law or regulatory authority
• We discontinue the relevant service

You may stop using our services at any time by ceasing communication with our WhatsApp number. Termination does not affect any rights or obligations that arose before termination, including payment obligations.

Upon termination, your license to access course content is revoked. However, digital badges and cheat sheets already delivered to you remain yours to keep.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of our services shall first be attempted to be resolved amicably through direct communication with our support team at hello@coursaily.com. We will make every reasonable effort to resolve disputes within 14 business days.

If a dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.

Notwithstanding the above, Coursaily reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
